Terms & Conditions

By booking a charter with Shell Cove Offshore Adventures, all passengers agree to the following terms and conditions.

1 .BOOKINGS & PAYMENTS

    • A booking is confirmed once a deposit or full payment has been received.
    • Final payment and weather confirmation will be made approximately 3 days prior to your scheduled charter.
    • Failure to complete final payment by the required time may result in cancellation of your booking

2. CANCELLATIONS & NO-SHOWS

  • Cancellations must be made at least 5 days prior to the scheduled charter date.
  • Cancellations made within 5 days of departure will forfeit all payments made.
  • No-shows on the day of the charter will result in loss of full payment, with no refund or transfer.
  • Late arrivals that delay departure may result in reduced charter time with no refund.

3. WEATHER & SEA CONDITIONS

  • Charters are weather dependent and operate at the skipper’s discretion.
  • If weather conditions are deemed unsafe:
    • You will be offered a transfer to a future date, or
    • A full refund if rescheduling is not possible.
  • Weather decisions are based on marine forecasts, safety, and vessel capability.
  • Once a charter has departed, no refunds will be issued due to changing conditions or early return caused by weather or sea state.

4. SEA SICKNESS & PREPARATION

  • Sea sickness is not grounds for a refund.
  • Passengers are strongly advised to:
    • Take sea sickness medication the night before and morning of the trip
    • Eat a light meal before departure
    • Stay hydrated
  • Please consider your personal tolerance to offshore conditions before booking.

5. FISHING LICENCES & REGULATIONS

  • All fishing charters include a NSW fishing licence for the day.
  • Bag limits, size limits, and fishing regulations must be always followed.
  • Any illegal catch will be returned to the water immediately.

6. ALCOHOL & BEHAVIOUR

  • BYO alcohol permitted – cans only. No glass.
  • Excessive alcohol consumption, unsafe behaviour, or disorderly conduct will not be tolerated.
  • The skipper reserves the right to return to port early if behaviour is deemed unsafe.
  • No refunds will be issued if a charter is terminated early due to passenger behaviour.

7. SAFETY & AUTHORITY OF SKIPPER

  • The skipper always has full authority regarding safety, weather decisions, and vessel operation.
  • All passengers must follow crew instructions.
  • Failure to comply may result in early termination of the charter without refund.

8. VOUCHERS & GIFT CERTIFICATES

  • Vouchers are valid for 3 years from date of issue.
  • Vouchers can be:
    • Used on mixed charters, or
    • Put towards a private boat booking.
  • Vouchers are non-refundable and cannot be redeemed for cash.
  • Voucher bookings are subject to availability and weather conditions.

9. WHALE WATCHING CHARTERS

  • Whale watching charters are non-fishing trips.
  • No fishing equipment or fishing activities are permitted on whale watching trips.
  • All wildlife interactions are conducted in accordance with NSW marine regulations.

10. LIABILITY

  • Passengers participate at their own risk.
  • Shell Cove Offshore Adventures accepts no responsibility for loss, damage, or injury to personal belongings.
  • We recommend securing valuables and bringing only essential items onboard.
